Recreational Infrastructure Canada Program

BETWEEN:

THE GOVERNMENT OF CANADA (“Canada”), represented by the Minister of State (Economic Development Agency of Canada for the Regions of Quebec),

AND

THE GOVERNMENT OF QUEBEC (“Quebec”), represented by the Minister of Education, Recreation and Sport, the Minister of Municipal Affairs, Regions and Land Occupancy and the Minister responsible for Canadian Intergovernmental Affairs and the Reform of Democratic Institutions.

(collectively referred to as "the Parties")

WHEREAS, on August 11, 2009, the Parties signed the Canada-Quebec Agreement on the Recreational Infrastructure Canada Program (“the Agreement”);

WHEREAS the Agreement stipulates that sections 3.1.1 and 3.1.7 shall be amended if the share allocated to Quebec is amended by Canada;

WHEREAS Canada is allocating to Quebec an additional $38,724,602 to implement the Program;

WHEREAS the Parties want to amend the Agreement accordingly;

WHEREAS the Minister of State (Economic Development Agency of Canada for the Regions of Quebec) is authorized to sign this Amendment No 1 to the Agreement on behalf of Canada;

WHEREAS the Government of Quebec, pursuant to order-in-council number 62-2010 of January 26, 2010, approved the terms of Amendment No 1 to the Agreement;

NOW THEREFORE, the Parties agree to amend the Agreement as follows:

  1. Subsection 3.1.1 is replaced by the following:

    Subject to the appropriation by the Parliament of Canada and the National Assembly of Quebec of the funds for their respective shares in the Fiscal Year in which payment is required, Canada’s total contribution shall not exceed $76,077,275.

  2. The first sentence of Subsection 3.1.7 is replaced by the following sentence:

    Quebec shall appropriate a maximum of 3% of Canada's contribution described in paragraph 3.1.1, or $2,282,318, to repay 50% of its costs for management of the Agreement.
     

  3. Definitions

    All terms not defined in this Amending Agreement have the meaning given to them in the Agreement.

  4. Agreement

    All other terms and conditions of the Agreement remain unchanged.

  5. Obligations

    The Parties declare that the signing of this Amendment 1 to the Agreement was duly and validly authorized, and that each has incurred a legal and valid obligation in accordance with the terms and conditions of Amendment 1 to the Agreement.
     

  6. Counterpart Signature

    Amendment No 1 to the Agreement may be signed in counterpart, and the signed copies will, when attached, constitute the original Amendment No 1 to the Agreement.

    Amendment No 1 to this Agreement has been executed on behalf of Canada by the Minister of State (Economic Development Agency for the Regions of Quebec), and on behalf of Quebec by the Minister of Education, Recreation and Sport, the Minister of Municipal Affairs, Regions and Land Occupancy and the Minister responsible for Canadian Intergovernmental Affairs and the Reform of Democratic Institutions.
