Amendment to the Canada-Quebec Infrastructure Program Agreement (December 11, 2007)

Made the day of December 11, 2007

BETWEEN : THE GOVERNMENT OF CANADA (herein referred to as “Canada”) represented by the Minister of Transport, Infrastructure and Communities

AND : THE GOVERNMENT OF QUÉBEC (herein referred to as “Québec”) represented by the Minister of Municipal Affairs and Regions

(collectively referred to as the Parties)

WHEREAS the Parties have entered into the Canada-Québec Infrastructure Program Agreement (“Agreement”) on the 18th day of July, 2005;

AND WHEREAS the Government of Canada has provided an additional $200 million to the $1 billion Municipal Rural Infrastructure Fund (MRIF), to be used to support infrastructure projects across Canada;

AND WHEREAS Canada and Québec intend to adjust the financial terms of their respective contributions to MRIF;

THEREFORE, in accordance with the principles set out above, Canada and Québec agree as follows:

  1. Section 6.1 is repealed and replaced by the following:

    “6.1 Despite any other provision of this agreement, and subject to the express condition that there be an appropriation by the Parliament of Canada with respect to the funds necessary for the fiscal year in which they are required, the total contribution by Canada under ICP shall not exceed $515,508,000, and, under MRIF, shall not exceed $234,824,000.”

     
  2. Section 7.5 b) is repealed and replaced by the following:

    “7.5 b) For the MRIF, Canada shall reimburse Québec an amount of up to $2,925,000 for the costs of managing and administering the agreement as determined and approved by the management committee. This amount shall be taken from Canada’s contribution as set out in paragraph 6.1”

     
  3. Section A.9.2 a) of Annex A is repealed and replaced by the following:

    “A.9.2 a) The total cost of works deemed eligible under the MRIF, excluding the management fees and administrative expenses provided in section 7.5 b) could reach $695,000,000. The budgetary envelope for each MRIF component is as follows:”

  4. Section A.9.2 c) of Annex A is repealed and replaced by the following:

    “A.9.2 c) A maximum of $1,950,000 of the MRIF funds shall be dedicated to MRIF 2.”

     
  5. Section A.10.2 of Annex A is repealed and replaced by the following:

    “A.10.2 Under the MRIF, the total contribution by Canada under the agreement will be notionally allocated as follows:”

  6. All other sections of the Agreement remain unchanged.
  7. This Amendment may be signed in counterpart, and the signed copies will, when attached, constitute an original Amendment.
